Terms of Service

Please read these Terms of Service ("Agreement") carefully. This Agreement is between ParFour, Inc. ("ParFour", "we", "us", or "our") and you ("you" or "your"). This Agreement governs your access to and use of ParFour's websites, mobile applications, and any related services, features, content, tools, and products that link to this Agreement (collectively, the "Services").
By accessing or using the Services, downloading our mobile application, creating an account, registering for or participating in events, uploading content, or clicking "I Accept" (or similar), you agree that you have read, understand, and agree to be bound by this Agreement and any other terms incorporated by reference. If you do not agree, do not use the Services.
If you are using the Services on behalf of an organization, school, club, tour, or other entity, you represent and warrant that you have authority to bind that organization, and "you" includes the organization.
Important Notice About Dispute Resolution
Section 17 contains an arbitration agreement and a class action waiver that affects your legal rights. Please read it carefully.

2. Changes to This Agreement
We may modify this Agreement at any time in our sole discretion. If we make material changes, we will provide notice through the Services, such as in app notice, or by email if we have it. Your continued use of the Services after the changes become effective means you accept the updated Agreement.
You are responsible for keeping your contact information current.
3. Eligibility, Youth, and School Use
You must be at least 13 years old to use the Services.
Users under the age of 18 may participate in the Services only with authorization from a parent, legal guardian, school, coach, club, or other authorized organization representative. By allowing a minor to use or participate in the Services, the authorizing party represents and warrants that all required parental or guardian consents have been obtained.
ParFour supports school, youth, amateur, and organized participation. Schools, clubs, tours, coaches, and event administrators may create and manage events involving minors and may access participant data as necessary to operate, score, and administer events.
ParFour does not independently verify parental consent and relies on parents, guardians, schools, clubs, and organizers to obtain and manage appropriate permissions.
You agree to use the Services in compliance with all applicable laws, rules, and regulations.
4. Accounts, Registration, and Organizational Roles
Some features may require an account ("User Account"). When you create a User Account, you agree to provide accurate information and keep it updated.
ParFour supports both individual accounts and organizational accounts, including clubs, schools, tours, leagues, facilities, and other organizations. Organizational accounts may designate administrators, coaches, managers, or other authorized users.
Authorized organizational users may manage events, registrations, payments, scoring, communications, and access participant data for events they administer.
Organizations are responsible for the actions of their authorized users and for compliance with applicable laws, school policies, and consent requirements.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
5. Events, Indoor Golf, Location Features, and Safety
ParFour provides tools for managing registrations, payments, scoring, scheduling, communications, and event operations for outdoor golf, indoor golf facilities, simulator environments, training centers, leagues, tournaments, and similar organized activities.
The Services may also be used for non golf events where registration, participant management, payments, and event administration are required, including clinics, camps, lessons, tryouts, practices, fundraisers, sponsorship activations, and similar events.
Certain features may include GPS overlays, course location display, live scoring, simulator inputs, or performance data provided by venues or third party systems.
You understand and agree that:
- Event participation, livestreaming, or content uploads may reveal personal information including name, image, voice, location, scoring, or performance data
- You are responsible for obtaining permission from anyone who appears in content you upload
- You must not use the Services in a way that encourages unsafe behavior or violates venue rules or laws
Location, scoring, and performance data are provided for informational and operational purposes only and are not guaranteed to be accurate. You should not rely on the Services for safety critical decisions.
Disabling location permissions may limit functionality.
6. Privacy
Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, store, and share information, including account data, event participation data, location data, performance data, and payment metadata.
The Privacy Policy is incorporated by reference into this Agreement.
7. License and Proprietary Rights
ParFour grants you a limited, revocable, nonexclusive, nontransferable, nonsublicensable license to access and use the Services in accordance with this Agreement.
ParFour owns and retains all rights in the Services and ParFour Content.
You may not copy, modify, distribute, sell, lease, reverse engineer, scrape, or misuse the Services except as expressly permitted by law or this Agreement.
8. Acceptable Use and User Conduct
You are solely responsible for your conduct and content. You agree you will not violate laws, infringe rights, post prohibited content, misuse the Services, or attempt to disrupt the platform.
ParFour may remove content or suspend accounts at its discretion.
9. Monitoring, Enforcement, and Investigations
We may monitor, investigate, and take action regarding violations, including accessing, preserving, and disclosing information to comply with law, enforce this Agreement, protect users, or ensure platform integrity.
10. Third Party Services
The Services may integrate with third party providers including Apple, Google, Stripe, mapping providers, analytics providers, simulator systems, and course data providers. Your use of third party services is governed by their terms.
11. User Content
You retain ownership of your User Content.
You grant ParFour a worldwide, perpetual, royalty free license to host, store, use, display, modify, and distribute User Content as necessary to operate, improve, and promote the Services, including marketing and promotional use.
We may remove content at any time.
12. Copyright and DMCA
ParFour respects intellectual property rights and responds to valid DMCA notices as required by law.
13. Payments, Fees, Subscriptions, and Refunds
ParFour offers subscriptions, one time payments for events, registrations, and sponsorship placements.
ParFour may facilitate payments on behalf of event organizers using third party payment processors such as Stripe. ParFour is not the merchant of record for events unless expressly stated at checkout.
Annual Plans
Annual plans are billed in advance for a twelve month term and are nonrefundable to the fullest extent permitted by law.
ParFour may, in its sole discretion, consider refund requests on a case by case basis. Any refund granted does not create an obligation to issue future refunds.
Failure to use the Services does not entitle a user to a refund.
Refunds, Chargebacks, and Disputes
Event refund policies are set by event organizers unless otherwise disclosed. Chargebacks and disputes may result in sharing transaction and participation data with payment processors and organizers.
Failed or reversed payments may result in loss of access to paid features.
14. Promotions and Advertising
The Services may include advertisements, sponsorships, or promotional placements in connection with events, profiles, or content.
15. Termination
You may stop using the Services at any time. ParFour may suspend or terminate access for violations, nonpayment, or risk to the platform.
Certain provisions survive termination.
16. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." PARFOUR DISCLAIMS ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
PARFOUR'S TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID IN THE THREE MONTHS PRIOR TO THE CLAIM OR $100.
17. Dispute Resolution and Arbitration
Disputes are subject to binding arbitration and a class action waiver as described in this section.
18. Miscellaneous
This Agreement is governed by Delaware law. Assignment, notices, and entire agreement provisions apply.
19. App Store Terms
This Agreement is between you and ParFour, not Apple or Google. Apple and Google are not responsible for the Services and may be third party beneficiaries as required by their terms.
